Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website reachspark.pro (the "Site") operated by ReachSpark Pte. Ltd. (UEN 202418736K), a company registered in Singapore with its registered address at 26 Duxton Hill, #02-01, Singapore 089608 ("ReachSpark", "we", "us" or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site immediately.

These Terms apply to website visitors and general users. If you engage ReachSpark for paid marketing agency services, a separate written service agreement, statement of work, or retainer contract will govern the commercial relationship and will prevail over these Terms to the extent of any inconsistency regarding deliverables, fees, and service-level commitments.

1. About ReachSpark and brand interpretation

ReachSpark Pte. Ltd. is a professional marketing agency based in Tanjong Pagar, Singapore. We provide brand strategy, paid media management, creative production, social campaigns, conversion optimisation, SEO recommendations, content marketing support, and analytics services for client brands across Singapore and the wider APAC market.

The ReachSpark name and branding carry specific meanings on this Site and in our communications:

  • "Reach" refers to marketing reach — the scale and quality of audience exposure achieved through planned media, content distribution, and campaign activity. It does not refer to physical reach, arm's-length contact, a customer-support phrase ("reach out to us" in a generic corporate sense), or any guarantee that content will achieve a particular audience size.
  • "Spark" refers to the creative spark of demand — the strategic and creative ignition that turns attention into qualified interest and measurable pipeline. It does not refer to Apache Spark, Apache Software Foundation products, electrical components, SaaS infrastructure, or any downloadable software tool.
  • ".pro" is part of our domain branding. It does not mean we sell a professional certification, a professional networking platform, or a software product licence.

Nothing on this Site should be interpreted as offering a marketing course, growth-hacking bootcamp, get-rich-quick programme, financial product, investment advice, or software-as-a-service subscription. ReachSpark is an agency that performs work for clients under contract — we are not a training provider, not a media publisher selling ad inventory directly to consumers, and not a financial adviser.

2. Permitted use

You may use the Site for lawful personal or business purposes, including learning about our services, reading case studies and FAQs, and submitting genuine enquiries through our contact channels. You agree not to:

  • Use the Site in any way that violates applicable laws or regulations in Singapore or your jurisdiction;
  • Attempt to gain unauthorised access to our servers, databases, or third-party systems connected to the Site;
  • Introduce malware, automated scraping bots, denial-of-service traffic, or other harmful code;
  • Copy, reproduce, republish, or commercially exploit Site content without our prior written consent, except for limited personal reference or sharing of public URLs;
  • Misrepresent your identity or affiliation when contacting us or submitting forms;
  • Use content from the Site to imply an endorsement, partnership, or client relationship that does not exist;
  • Harvest personal data of other users or our staff through the Site.

We reserve the right to restrict or terminate access for conduct that we reasonably believe breaches these Terms or harms the Site, our business, or other users.

3. Intellectual property

All content on the Site — including text, graphics, logos, photographs, page layouts, design elements, and underlying code — is owned by ReachSpark Pte. Ltd. or used under licence, and is protected by copyright, trademark, and other intellectual property laws. The ReachSpark name and logo are trading identifiers of ReachSpark Pte. Ltd.

You receive a limited, non-exclusive, non-transferable, revocable licence to view and temporarily download portions of the Site for personal, non-commercial use. This licence does not permit modification, reverse engineering, bulk extraction, or creation of derivative works. Case study metrics, creative samples, and portfolio descriptions are presented for illustration; underlying client assets remain the property of respective clients unless otherwise stated.

4. Enquiries and no automatic engagement

Submitting a contact form, email, or telephone enquiry does not create a client relationship, obligation to provide a proposal, or commitment to accept a project. All agency engagements require mutual agreement on scope, fees, timelines, and terms documented in a written contract. We reserve the right to decline enquiries that fall outside our expertise, ethical guidelines, or capacity — including requests related to prohibited industries described in our FAQ.

5. Marketing disclaimer and no guaranteed results

ReachSpark provides marketing and advertising services. The nature of marketing is inherently variable. We do not guarantee specific outcomes, including but not limited to:

  • Search engine rankings or organic visibility positions;
  • Social media virality, share velocity, or follower growth rates;
  • Audience reach, impressions, or frequency at any particular level;
  • Lead volume, conversion rates, sales, revenue, or profit;
  • Return on advertising spend (ROAS), return on investment (ROI), or cost-per-acquisition (CPA) targets;
  • Award wins, press coverage, or influencer amplification.

Any metrics, benchmarks, case study figures, or performance ranges mentioned on the Site, in proposals, or in conversations are illustrative of past work, industry context, or planning assumptions. They are not promises or warranties of future performance. Actual outcomes depend on many factors outside our direct control, including your budget, product-market fit, competitive landscape, seasonality, platform algorithm changes, creative quality, landing-page experience, sales follow-up, and macroeconomic conditions.

Testimonials, anonymised case studies, and sample dashboards are provided for transparency about the type of work we do, not as earnings claims or performance guarantees. You should make engagement decisions based on your own due diligence and documented scope — not on the assumption that prior results will repeat.

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which explain how we collect and process personal data under Singapore's Personal Data Protection Act. 9. Limitation of liability

To the maximum extent permitted by applicable law, ReachSpark Pte. Ltd. and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the Site — even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to these Terms or your use of the Site (excluding liability that cannot be excluded under Singapore law) shall not exceed SGD 100. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.

10. Indemnity

You agree to indemnify and hold harmless ReachSpark Pte. Ltd. from any claims, losses, damages, liabilities, and reasonable legal costs arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Singapore, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Singapore, except where mandatory consumer protection laws in your home jurisdiction provide otherwise for non-waivable rights.

12. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date at the top of this page indicates when the current version took effect. Material changes will be posted on the Site. Continued use after changes constitutes acceptance of the revised Terms. If you disagree with updated Terms, you must stop using the Site.

13. Severability and entire agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and ReachSpark regarding use of the Site, superseding prior oral or written understandings on that subject.
